Energy Policy WA has recommended that the capacity threshold for the generation licence exemption in the be increased from 30MW to 100MW.
The recommendation is being made as an interim measure to reduce regulatory costs for industry while a proposal to remove the requirement for generators of any size to hold a licence is progressed for further government consideration.
No additional conditions will be attached to the updated exemption, given other mechanisms that ensure generating works operate safely and deliver reliable and secure electricity supplies.

Decision Paper
The Decision Paper, A new threshold for application of the electricity generation licence exemption, presents Energy Policy WA’s final recommendation to the Minister for Energy following consideration of stakeholder feedback received in response to the consultation paper.
The final recommendation is consistent with the initial recommendation presented in the consultation paper.
The decision paper is not open to public comment.
Implementation
In August 2022 following consideration of stakeholder feedback, the Minister for Energy endorsed the recommendation to increase the generation licence exemption threshold from 30MW to not more than 100MW.
The regulatory amendments to bring this recommendation into effect come into effect on 22 October 2022
